Abstract

The theme of this article is the influence of Plato and his work The Republic on the legal reasoning of decisions in the Supreme Federal Court (STF). The research investigated the central problem: have the philosopher Plato and his work The Republic been employed as an argumentative subsidy in decisions handed down by the Supreme Federal Court, given its intrinsic relationship with the concept of Justice? The raised hypothesis postulates that Plato’s thought and his ideals are, in fact, employed as an argumentative subsidy, conferring axiological solidity and conceptual rigor to the Court's decisions. The general objective is to identify and analyze the utilization of The Republic and Plato's thought as judicial foundation in the Brazilian Constitutional Court over the last ten years. To this end, the specific objectives were: to highlight the role of Plato's contribution to the conception of justice in Western thought; to analyze Supreme Federal Court decisions that use Platonic concepts and to demonstrate the importance of Plato as an argumentative subsidy in the formation of these decisions. This work is important for the legal practitioner by strengthening the quality of legal reasoning and argumentation, while for science, it contributes to the Philosophy of Law by mapping the projection of classical concepts onto contemporary Constitutional Law.
