Abstract

The theme of this article is The Curatela of the Elderly from the Human Rights Perspective. The following problem was investigated: "The Curatela of the Elderly is in the legal framework of Human Rights." The following hypothesis was considered: "Requests for Curatela of the Elderly are under the normative aegis of Human Rights of the Elderly". The general objective is "To identify under the normative, theoretical and empirical triad the requests for interdiction and causes of the elderly person's request under the theoretical framework of Human Rights". The specific objectives are "To analyze requests for curatela and causes of requesting under the normative aspect of Human Rights"; "Identify situations that violate human rights, the causes of request, in line with international human rights law." "State by age group, request and cause of request of Elderly prohibitions." This work is important from an individual perspective because of its relevance to the violation of self-determination of the elderly; for science, it is relevant for addressing aspects involving the increase of life expectancy of the elderly in Brazil and the direct interference in the autonomy of the elderly in managing fundamental aspects of their lives; It adds to society for bringing elements within a new look, about the active and healthy aging of the elderly and their impacts on personal choices. This is a theoretical qualitative research lasting six months.
