Abstract

In the face of the phenomenon of collectivization of rights, the participation of of the Judiciary in matters of great social relevance, called to decide through the analysis not only of the rule put forward, but, above all, of the contexts sociological, cultural, political and economic in which immersed society. The most important and challenging problems facing current, stem from massification. The answers previously offered by the system intersubjective conflicts (traditional individual conflicts) are insufficient for this new reality. Therefore, in seeking to offer more effective solutions to the new litigations deducted in court, the judiciary understood that it was essential to change the way Constitution and laws. Approaching the tangible reality, taking center stage in the political and social setting has become a requirement for Jurisdiction. As a consequence, the the role of instrument for a 'just' legal order and not only seeking to confer the maximum concreteness of the norms.
