Abstract

In a country with large territorial dimensions such as Brazil, the possession has always generated a large number of conflicts in most cases including the use of violence. In this context the ownership of land, its concept and understanding have evolved over time to the status of fundamental rights constitutionally protected by the Brazilian Constitution of 1988. In the world context, Weiner's Constitution of 1919 was the first to recognize property as a fundamental duty. The Universal Declaration of Human Rights was a legal achievement. of the victory of the democratic powers against the countries of authoritarian, Nazi regime or fascist movement, adopted on December 10, 1948, on the initiative of the UN, in its article XVII
