Principle of the primacy of judgment on the merits and the jurisprudence of the TJDFT

Abstract

Jurisprudential research on the application of the principle of the primacy of resolution of merit, in the civil classes of the TJDFT. Finding that the principle of primacy is used together with the principles of cooperation and instrumentality of forms, excess of rigor in the judgment, extinction, without resolution of merit, for rejection of the initial petition, search and seizure, fungibility in the admissibility of the appeal and as well as in the analysis of the harmfulness of the internal grievance, or withheld, in view of the judgment of the instrument grievance.
