Abstract

The work in Sports Justice is arduous and demands from its members (auditors, prosecutors and defenders) extreme agility to comply with the specific legislation, especially regarding the time limits for cognition of the existence of typical, unsportsmanlike and guilty conduct. I urge that the temporal limit of the sporting process that appreciates disciplinary quarrels and affects sports competitions is governed by the Federal Constitution of 1988, not only by the constitutional guarantee to the reasonable and rapid duration of the process (article 5, item LXXVIII2), but by the own art. 217, §§ 1 and 2, which establishes the period of 60 (sixty) days for the alleged infractions and issues mentioned to be assessed by the Sports Court.
