Abstract

The purpose of this article is to reflect on affirmative action, with an emphasis on of racial quotas, as a way to promote the equality of socially isolated groups or
economically and analyze the legitimacy and justice of this type of action. Therefore, the main focus of this study focuses on positive racial discrimination, that is, reverse discrimination or, as we are dealing with in Brazilian legal doctrine, discrimination protected by law, the affirmative action. Affirmative action is understood to mean any public or private policy aimed at to promote social inclusion and to ensure the existence of a society effectively pluralistic There are national examples of affirmative action: ensuring the minimum number of women in political parties and quota policies for people with disabilities special and for afro-descendants.
