Repetitive themes on traffic offenses and crimes from the perspective of the TJDFT
Keywords:
traffic offenses, STJ, STF, TJDFT, abstract danger, disobedience, administrative sanctionsAbstract
This article examines how the Federal District and Territories Court of Justice (TJDFT) applies three important legal doctrines related to traffic offenses and crimes, as established by the Superior Courts (STJ and STF). STJ Theme 901 deals with the crime of entrusting a motor vehicle to an unqualified or unfit person, classified as an abstract danger offense. STJ Theme 1060 addresses disobedience to a legal stop order issued by public security agents. Finally, STF Theme 1079 addresses the refusal to undergo alcohol testing and the associated administrative sanctions. The analysis shows that the TJDFT closely follows the superior courts' guidance, reinforcing the uniformity in the application of traffic legislation.
