Personal Data Protection and Cybersecurity in Algerian Legislation

Resumo

Algerian society is witnessing an increase in cybersecurity threats due to the growing reliance on digitalization, making the protection of personal data a central pillar for ensuring fundamental individual rights, which are intertwined with the use of modern technologies and digital security requirements. Through Law No. 18-07, the Algerian legislator attempted to regulate the processing of personal data and ensure its confidentiality. However, this legislation faces tangible challenges in establishing a substantive balance between privacy protection and the requirements of the digital sphere, particularly in light of the proliferation of cybercrime and the growth of digital data surveillance. The importance of the National Authority for Data Protection emerges as a supervisory tool to balance individual rights with the necessities of national security. Despite legislative efforts, this balance remains fragile and needs reinforcement through the development of more effective legal and technical mechanisms. The study of this topic reveals the limitations of the current legislation and highlights the need for a future revision aimed at strengthening the protection of individual rights without compromising cybersecurity.
