Abstract

The theme of this article is The Characteristics and Deployment of the Police Inquiry: Applicability of Fundamental Rights of Broad Defense and Contradiction. The following problem was investigated: how can police investigations carry out their investigative actions more effectively, respecting the broad right to defense and the adversary? and the following hypothesis was considered: The basic structure for understanding this discussion is based on different issues that are determinant for the unfolding of investigations and understanding of the existential processes of the presumption of Innocence and also of the dignity of the human person. The General objective is to carry out a systematic analysis of the dynamic complexity of the Rights of Broad Defense and the Contradictory Rights in the Police Inquiry. The specific objectives are: Conceptualize Police Inquiry; conduct a study on broad defense and the adversarial; explain what presumption of innocence is. For science, a discussion is relevant that can contribute to the academic community a bibliographic material that dynamically details this study topic; aggregates society because it is a discussion that deals with the fundamental rights of the citizen in a democratic state of law. This is qualitative theoretical research lasting six months.
